The terms governing use of this site.
By accessing or using sendmarshmallows.com (the “Site”), signing up for updates, writing a note, or sending a bag of marshmallows, you agree to be bound by these Terms of Use. If you do not agree, please do not use the Site.
1. What This Campaign Is
Send Marshmallows is a campaign run alongside the book Marshmallows Are Their Favorite by Lindsay Oliver. When you send a bag, you are contributing to a single coordinated delivery to the National Primate Research Centers — a treat for the monkeys, and a message to the institutions that hold them.
Nothing is shipped to you. You are not buying marshmallows for yourself. The bags and the notes go to a research center, which is why no delivery address is collected for the bags themselves.
Not a donation. Send Marshmallows is a campaign, not a charity. Contributions are not donations and are not tax-deductible. No money is paid to the research centers.
2. Delivery Is Not Guaranteed
We will make every reasonable effort to deliver the bags and the notes. Whether a research center accepts the delivery, and whether the treats are given to the animals, is entirely outside our control. A center may refuse the delivery, discard it, or decline to distribute it, and we cannot promise otherwise.
Contributions are not refundable on the basis that a center refused or did not distribute a delivery. Accepted or refused, the message is still delivered and still counted.
We also cannot promise a specific delivery date. Bags and notes are collected and sent as one campaign delivery; we will email you when yours is on its way.
3. Your Note
By submitting a note you confirm that it is your own, and you grant us permission to print it on a card and deliver it to a research center alongside the bags, together with the display name you choose.
Notes must not contain threats, harassment, abuse, obscenity, personal information about any individual, or anything unlawful. We may decline to send a note that breaks these rules, and may edit obvious typos for legibility. We do not otherwise change what you write.
Your note and display name will only be published on this Site, on social media, or in campaign materials if you give permission at the time you write it. See the Privacy Policy for how this works.
Notes can be submitted free of charge. You do not have to buy anything to send a message.
4. Orders and Payments
Bags are sold through a separate hosted store and payment platform linked from this Site. Payments and order confirmation are handled by that platform and are governed by its terms and policies in addition to these.
All sales are final. Contributions are not refundable, including where a research center refuses or does not distribute a delivery (see section 2).
Prices are shown in US dollars. The figure shown on this Site before checkout is an estimate of your total; the amount charged is the one shown at checkout.

5. Campaign Figures
The counters on this Site — bags sent, approximate marshmallows, notes written — are indicative campaign totals and may be updated periodically rather than in real time. The marshmallow figure is an approximation based on a typical bag.
6. Use of the Site
You are granted a limited, non-exclusive, non-transferable license to access and use the Site for lawful, personal purposes.
You agree not to:
- Misuse the Site, interfere with its operation, or attempt to gain unauthorized access to our servers, networks, or user data.
- Use automated systems to submit notes or orders, or to harvest data or content from the Site.
- Copy, reproduce, distribute, resell, or commercially exploit Site content except as expressly permitted.
- Impersonate any person or entity, or provide false information when signing up, writing a note, or placing an order.
7. Intellectual Property
All content on this Site — including text, graphics, logos, photographs, illustrations, and overall design — is owned by Lindsay Oliver or used with permission, and is protected by United States and international copyright, trademark, and intellectual property laws. Any other use requires prior permission unless otherwise allowed by law.
8. Email & Communications
By signing up for updates, or by sending a bag or a note, you consent to receive email about the campaign and its progress. You can opt out at any time using the “unsubscribe” link at the bottom of any email. We will still email you about an order you have placed.
9. Third-Party Links & Services
The Site uses third-party services for hosting, e-commerce, payments, and email delivery, and links to external sites including lindsayoliver.com. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party site or service.
10. Disclaimer
This Site is provided for informational and campaign purposes. Nothing on it is intended as legal, veterinary, medical, or other professional advice.
The Site and everything delivered through it is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. We do not guarantee that your use of the Site will be uninterrupted, timely, secure, or error-free.
11. Limitation of Liability
To the fullest extent permitted by law, in no event shall Lindsay Oliver, Send Marshmallows, or any affiliated parties be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind arising from your use of the Site, any linked third-party site or service, or any contribution made through the Site.
12. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Any legal action arising out of these terms shall be filed exclusively in the courts located in Wyoming.
13. Changes to These Terms
We reserve the right to update, change, or replace any part of these Terms of Use at any time. Your continued use of the Site following the posting of changes constitutes acceptance of those changes.
